Well... They could atleast make a physical print based on the number of pre orders. They are alienating their existing fanbase.. I mean people that play these games probably enjoy having the games in their collections.
If it is the only way it can be released Im not gonna complain, I can always solve the problem by importing a japanese physical copy but then I will have to technically buy the game twice.

This kind of turned me off but I'll take what I can get. I really love the ace attorney series.

Hey, I know that! That's why I clearly stated that they would only make a limited physical print based on the number of pre orders. Basically they would make some kind of announcement where they state that they will only print as many copies as there are pre-orders. They could benefit from that because it wouldnt have to go through the process of retail, making it a little bit more profitable, they could handle the distribution themselves.
If it reached a certain number of pre orders, Im sure it would be a profittable affair. They could have tested the waters.

^ I don't think it's as simple as that or XSeed would have optioned that for a few titles by now (of course I could be wrong).  I think it's like any retail thing.  The more you make, the cheaper it is for you.  If you print too many, your company loses money; if you print too few it becomes too rare (and maybe not worth the costs of actually going into the steps of making a physical copy: packaging/distribution and all that).
Also, not to point fingers, and I have no facts or numbers with how Apollo/Phoenix titles have been pirated, but:

Blame people for maybe why sales have been so low.

Also, If you have the time, Tom's posts (a staff member for Xseed who posts on the official forums) on the Trails in the Sky sub forum are reeeaally enlightening; he gives quite a lot away about the barriers they face for a lot of their niche items, budget constraints, and so forth.  While not 100% applicable to the Phoenix series, I think it still does provide some good insight.

 I understand your point. I also follow the xseed forums :)
 However the idea would be to see if the number of pre orders would justify the printing of physical copies. Im not going crazy over this, I am much more concerned about actually playing the games.(Yay for the Investigations 2 fan translation btw)
 Pirating wouldnt be the only issue, I think a bigger issue is the lack of marketing and advertisements for the series. I had no clue the games existed if it weren't for the youtube rpg community. Also they arent really available in my country for example(It's european), the games are just not accessible, that's why perhaps some people resort to pirating.

The digital release will solve the accessability issue atleast.

^ Basically, I hate resorting to Fan Translations even though I'm grateful (mainly because you 100% don't pay for them then).  But yeah, the internet is a marvellous place at least for finding these things.

Star Ocean 1 on the SNES was one of those golden opportunities (and actually made the "advanced" PSP version leave a bad taste in my mouth).
