3D Dot Quest 8 music = same?

The main menu music in 3D Dot Game Heroes has to do with Dragon Quest 8 (and 9!) does it not?

Rappers sue over less.  Rappers sue game companies over less, like that backup singer from Cypress Hill.

So yeah, I probably missed this conversation when this game was new.  Maybe that Cypress Hill lawsuit.. zzzz....

I only mentioned the Rockstar games lawsuit because it is an example of another type of likeness being used.  Basically, this rapper is suing them because he looks like the main character.  If Square Enix were as petty as Cypress Hill's singer, would they have a case?  Are melodies more quantifiable than appearances?  Is there such a thing as 'musical likeness'?  Here is the story http://www.gamasutra.com/view/news/31952/Cypress_Hill_Singer_Sues_Rockstar_For_250M.php

Anyway, I just thought it was neat that the music is so similar, and was wondering if anyone else noticed.

Oh yeah, it's definitely inspired by DQ8. Heck, I'd be hard pressed to call 3D Dot Heroes anything more than a mash-up of other RPGs with a 3D sprite editor built in. It doesn't have a lot of original ideas, it's more of a fan tribute than anything.
